The document availabe above is a letter from EVMWD's law firm, Best Best & Krieger (BB&K), to the California Public Utilities Commission (CPUC). The letter forwards a draft Memo of Understanding (MOU) between EVMWD and the CPUC.

The forwarding letter from BB&K changes EVMWD's long standing position on the LEAPS Project. In the past, EVMWD's interest in the LEAPS Project was principally to maintain the water level in Lake Elsinore. The District expressed no interest in being the operator of the Power Plant. That position was changed in the BB&K letter. It's stated there, multiple times, that EVMWD will be the operator. It is also stated that the EVMWD is a "proponent" of the project. (In the past, EVMWD has taken a much more subdued position of "just wanting to do what's best for the Lake and their customers".)

So, it now appears that EVMWD has ambitions of becoming the Elsinore Valley Municipal Water and Power District.

The MOU is structured to make EVMWD and the CPUC co-lead agencies in the task of preparing the California Environmental Impact Report (EIR).

It's made clear that the CPUC is interested primarily in the Power Line associated with the LEAPS Project. But, they respect the fact that EVMWD has the overall lead for the entire LEAPS Project and that the Project may not be divided into separate pieces for the Power Line and Power Plant. So, EVMWD and the CPUC are, in effect, joining forces to produce the necessary EIR.

It is particularly interesting that the optimistic date for completing the EIR that is memtioned in the draft MOU is December 2008. That's another year later that the most recent completion date that EVMWD had been forecasting.
